Terms of Service for BENATEX PAINTS ENTERPRISES

These Terms of Service govern the access to and use of the podcast-studio services, website, facilities, equipment, and related offerings provided by BENATEX PAINTS ENTERPRISES (“we,” “us,” “our,” or the “Service Provider”). By booking, accessing, or using any of our services, you agree to be bound by these Terms of Service.

1. Introduction and acceptance of terms

These Terms of Service constitute a legally binding agreement between you and BENATEX PAINTS ENTERPRISES regarding your use of our services, including studio rental, recording, editing, mastering, videopodcast production, technical hosting, jingle adaptation, and consulting services.

By making a booking, entering our premises, using our equipment, or otherwise engaging our services, you confirm that you have read, understood, and accepted these Terms of Service in full. If you do not agree, you must not use our services.

Where a client acts on behalf of a company, organization, or other legal entity, that entity and the individual accepting these terms represent and warrant that they have authority to bind the entity to these Terms of Service.

2. Scope of services

BENATEX PAINTS ENTERPRISES operates a podcast-studio business and may provide one or more of the following services, subject to availability and separate booking confirmation:

Any timeline, deliverable, or output estimate provided by us is approximate unless expressly agreed in writing.

3. User obligations and responsibilities

You agree to use our services responsibly and in compliance with all applicable rules, laws, and studio instructions. In particular, you must:

  • Provide accurate, complete, and current information when booking or communicating with us.
  • Arrive on time and ensure all participants are prepared for the booked session.
  • Follow all safety, access, and equipment-use instructions given by our staff or technical hosts.
  • Use the studio, equipment, and facilities only for lawful purposes.
  • Not bring prohibited items, hazardous materials, illegal substances, or weapons onto the premises.
  • Not damage, tamper with, reverse engineer, or misuse any equipment, software, or studio infrastructure.
  • Ensure that any content recorded, published, or distributed through our services does not infringe third-party rights or violate applicable law.
  • Obtain all necessary permissions, releases, licenses, and consents for guests, music, images, trademarks, and other third-party materials.

You are solely responsible for the content you create, provide, record, publish, or distribute using our services. We do not assume responsibility for the legality, accuracy, or appropriateness of client content.

You must compensate us for any loss, damage, cleaning costs, repair costs, or third-party claims arising from your breach of these Terms of Service, negligence, or misuse of the studio or equipment.

4. Payment terms and conditions

All fees, rates, deposits, and payment schedules will be communicated at the time of booking, in a quotation, invoice, service agreement, or other written confirmation from BENATEX PAINTS ENTERPRISES.

  • Payment may be required in advance, in part, or in full before service delivery.
  • Bookings are not confirmed until any required deposit or advance payment has been received.
  • Unless otherwise stated, all prices are exclusive of applicable taxes, duties, and bank charges.
  • Late payments may result in suspension of services, withholding of deliverables, or cancellation of bookings.
  • You are responsible for any transfer fees, card fees, currency conversion charges, or bank deductions.

If additional work is requested beyond the original scope, including extra editing, extended studio time, reshoots, re-recordings, or special technical support, we may charge additional fees at our then-current rates.

Invoices must be paid by the due date stated on the invoice. Overdue amounts may accrue reasonable administrative charges and, where permitted by law, interest.

5. Cancellation and refund policy

Cancellations and rescheduling requests must be made in writing or through the communication channel designated by BENATEX PAINTS ENTERPRISES.

  • Deposits may be non-refundable unless otherwise agreed in writing.
  • Cancellations made close to the booking time may incur cancellation fees.
  • No-shows or late arrivals may be charged in full or partially, depending on the reserved time and resources allocated.
  • Refunds, if any, will be issued only where required by law or expressly agreed in writing.
  • Completed services, including recording, editing, mastering, and consultation work already performed, are generally non-refundable.

If we must cancel or reschedule due to technical failure, safety concerns, staff unavailability, or force majeure, we will make reasonable efforts to offer an alternative time or service credit, but we are not liable for indirect losses resulting from such cancellation.

6. Liability limitations

To the maximum extent permitted by applicable law, BENATEX PAINTS ENTERPRISES shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of business, loss of data, reputational harm, or loss of opportunity.

We do not guarantee uninterrupted, error-free, or fully secure operation of the studio, website, equipment, or digital services. While we take reasonable care to maintain our facilities and equipment, all services are provided on an “as available” basis.

Our total aggregate liability arising out of or relating to any service, booking, or these Terms of Service shall be limited to the amount actually paid by you for the specific service giving rise to the claim, except where a greater limitation is prohibited by law.

Nothing in these Terms of Service excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or wilful misconduct where such exclusion is not permitted.

7. Intellectual property rights

All intellectual property rights in our website, branding, studio systems, templates, workflows, editing methods, technical materials, and proprietary content remain the property of BENATEX PAINTS ENTERPRISES or its licensors.

Subject to full payment of all applicable fees, and unless otherwise agreed in writing, you will receive the rights expressly granted in the relevant service agreement or invoice terms for the final deliverables produced for you.

You retain ownership of your pre-existing content, including scripts, recordings, images, logos, and music supplied by you, provided that you have the necessary rights to use and share such materials.

You grant us a limited, non-exclusive license to use your materials solely to the extent necessary to provide the services, store backups, perform edits, manage delivery, and comply with legal obligations.

We may, with your prior written consent where required, use excerpts of completed work for portfolio, promotional, or showcase purposes. If no consent is given, we will not use your content for marketing purposes except where permitted by law.

8. Data protection and privacy

BENATEX PAINTS ENTERPRISES may collect and process personal data such as names, contact details, booking information, payment information, session preferences, and technical metadata for the purpose of providing and managing our services.

We will handle personal data in a manner intended to be lawful, fair, and secure, and we will take reasonable measures to protect it against unauthorized access, disclosure, alteration, or destruction.

We may use third-party service providers for payment processing, hosting, communication, storage, analytics, or delivery of digital files. Such providers may process data on our behalf subject to appropriate safeguards.

You are responsible for ensuring that any personal data, voice recordings, images, or other information you provide to us for processing has been collected and shared lawfully, including obtaining any required consents from guests or participants.

Where applicable, you may contact us to request access, correction, deletion, or restriction of your personal data, subject to legal and operational limitations.

9. Force majeure

BENATEX PAINTS ENTERPRISES shall not be liable for any delay, failure, or interruption in performance caused by events beyond our reasonable control, including but not limited to power outages, internet failures, fire, flood, storm, civil unrest, government action, epidemic, labor disputes, equipment failure, supply shortages, or acts of God.

In the event of force majeure, we may suspend services, reschedule bookings, or modify performance obligations for the duration of the event and for a reasonable recovery period thereafter.

10. Changes to terms

We may revise these Terms of Service from time to time to reflect changes in our services, operational practices, or legal requirements. Updated terms will become effective upon posting on our website or upon written notice, as applicable.

Your continued use of the services after any update constitutes acceptance of the revised Terms of Service. If you do not agree to the updated terms, you must discontinue use of our services.

11. Applicable law and jurisdiction

These Terms of Service shall be governed by and interpreted in accordance with the laws applicable to the operations of BENATEX PAINTS ENTERPRISES, without regard to conflict-of-law principles, to the extent such choice is legally effective.

Any dispute arising out of or relating to these Terms of Service, the services provided, or any booking shall be submitted to the competent courts or dispute-resolution forum having jurisdiction over the location of the Service Provider, unless mandatory law requires otherwise.

Before initiating formal proceedings, the parties agree to attempt in good faith to resolve disputes through direct communication and reasonable negotiation.

13. Severability clause

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a competent authority, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed.

The remaining provisions shall continue in full force and effect. Any failure by BENATEX PAINTS ENTERPRISES to enforce a provision shall not constitute a waiver of that provision or any other right.
